POSITION -COUNTY LEGAL COUNSEL (3 positions)

Terms of Service-Permanent and Pensionable

Job Group -P

JOB PURPOSE

This positions function entails the undertaking litigation matters and defending the Government of the County Government of Mombasa in all suits that the county or its dully authorized agents is party to. The successful candidates will be responsible for reviewing and undertaking the current and future litigation matters as directed by the Office of the County Attorney from time to time. The person shall, among other things handle litigation, provide advice on ADR and early settlements, handle risk assessment and mitigation, assist in identifying any gaps in the litigation section and provide adequate defense(s) in all litigation matters on behalf of the Government of the County of Mombasa and its agents.

KEY RESPONSIBILITIES AND DUTIES

  • Provide Overall legal representation in cases where the County Government of Mombasa or its duly authorized agents is party to legal proceedings before a court of law as may be directed by the Office of the County Attorney
  • Engage on strategic litigation where the interest of the County Governments, matters pertaining to devolution or public interests’ litigation
  • Identify, file and follow up on high impact cases where the Government of County of Mombasa or its agents is a party as may be determined by the Office of the County Attorney
  • Risk assessment and mitigation
  • Litigation estimates and projections.

PERSON SPECIFICATION

  • Have solid experience in litigation matters especially involving land related matters, judicial review, constitutional matters, public procurement and contracts.
  • Demonstrate the capacity of analyzing complex legal problems rigorously and from both practice and academic angles while showing practical judgements.
  • Have capacity to establish and develop a litigation policy that meets the needs of the County Government of Mombasa,
  • Flexible and easy going, but hard working and deeply committed and passionate about litigation
  • Excellent verbal and written communication in both (English and Kiswahili) and computer skills.

ACADEMIC QUALIFICATION AND EXPERIENCE

  • For appointment to this position, an applicant must be in possession of the following minimum qualifications: –
  • Have a Law Degree from a reputable and recognized university by Commission of University Education.
  • Have a Diploma from the Kenya School of Law and have been admitted to the Roll of Advocates;
  • Must not have any pending complaints with the Advocates Complaints Commission, the Disciplinary Committee or adverse report from current and previous employer(s);
  • Have served in private practice with five (5) years post admission experience and a current practicing certificate and
  • Knowledge of Court procedures on strategic litigation and contemporary issues on devolution
  • Must meet the requirements set out in Chapter six of the Constitution of Kenya.
  • The successful candidates will be deployed to the Officer of County Attorney, Litigation Section and will be reporting to the County Director Legal Matters.

POSITION – LIAISON, PARTNERSHIP AND LINKAGES OFFICER

JOB PURPOSE

This position entails giving technical support to the office of the County Attorney in liaison and partnership with other county departments and key stakeholders in the legal fraternity to realise enforcement and compliance on legal obligations vested on the county government of Mombasa by the law. The person shall establish a framework to give the Office of the County Attorney a platform to consult widely and enhance cooperation amongst the county departments, county assembly and other players in the legal profession to achieve the functions of the Office of the County Attorney.

KEY RESPONSIBILITIES AND DUTIES

  • Shall ensure there is proper liaison and linkages between the Office of the County Attorney with other county governments departments, the National Government and the Council of Governors on all legal matters as the County Attorney may direct from time to time;
  • Enhance synergy among the county departments in coming up with legislative proposal for the County Executive;
  • Offer technical support to the Office of the County Attorney to discharge advisory on both legislative and other legal matters that are being undertaken by the County Government;
  • Identifying potential partners and networks to contribute to legislative reforms and developments at the county department level and professional training activities as well as legal research and policy advisory;
  • Developing internal institutional linkages related to legal compliance within the county departments as may be required by the County Attorney;
  • Advising and assisting the Office of the County Attorney in documenting and negotiating agreements, protocols and contracts with external partners;
  • Managing compliance of contractual agreements of various partners;
  • Any other duty as the County Attorney may determine from time to time.

PERSON SPECIFICATION

  • Have a clear vision to understand the legal regime under the Constitution and the County Government in order to seek and secure long term sustainable enforcement and realization of these laws;
  • Excellent analytical and research skills with exemplary writing skills in reports;
  • Excellent interpersonal skills, public relation and networking skills;
  • Ability to work both independently as well as being a team player, builder and able to deliver under pressure and meet strict timelines; and
  • Excellent verbal and written communication (English and Kiswahili) and Computer skills (Microsoft Office Programs).

ACADEMIC QUALIFICATION AND EXPERIENCE

  • Bachelor’s Degree in Law from a reputable and Recognized University by the Commission of University Education;
  • A certificate in computer proficiency and applications;
  • Proven strong written and oral communications skills;
  • Strong public relations qualities, analytical and problem-solving skills;
  • Experience in establishing partnerships with local legal networks;
  • Extensive experience interacting and communicating with senior management and executives;
  • Must possess the qualification set out in Chapter Six of the Constitution of Kenya.
  • The successful candidates will be deployed to the Officer of County Attorney, and will be reporting to the County Attorney.
